This policy forms part of the CouthActs Terms of Service and applies to every User, including Customers, Providers, business accounts and AI Agents acting for them. Capitalized words have the meanings in the Terms. Following this policy does not relieve you of any legal obligation; where the law is stricter, the law applies.
1. Prohibited Items
You must not post, bid for, book, tender or carry any of the following through the Services:
- anything whose possession, sale or transport is illegal at the origin, destination or any point in transit;
- controlled substances and drug paraphernalia, including cannabis and cannabis products (which remain controlled under U.S. federal law), except prescription medicines carried by a licensed medical transport Provider for a lawful purpose;
- explosives, fireworks, ammunition in bulk, and weapons of mass destruction or their components;
- firearms, firearm parts and suppressors, except where the Customer and Provider are both licensed or otherwise legally permitted to ship and carry them, the items are declared, unloaded and packaged as the law requires, and the Job is posted in a mode and with a Provider authorized to carry them;
- counterfeit, stolen or pirated goods, or goods that infringe intellectual property rights;
- goods subject to sanctions, embargoes or export controls without the required license, or destined for a prohibited person or end use;
- endangered or protected species, or their parts, without the permits required by the Convention on International Trade in Endangered Species (CITES) and applicable wildlife laws;
- animals for fighting, or any animal transported in conditions that are cruel or unlawful;
- human remains, organs, tissue, blood or bodily fluids, except by a Provider licensed to transport them;
- infectious substances, medical waste and radioactive material, except by a Provider licensed and equipped for them in the appropriate mode;
- people who have not freely agreed to travel, or any person being moved for trafficking, smuggling, forced labor or exploitation;
- currency, monetary instruments, precious metals and valuables in amounts that require declaration, reporting or licensed carriage, unless the Job is posted in the Armored Transport mode with an appropriately licensed Provider and the items are declared;
- anything a Provider has said it will not carry, or that the Provider's authority, license or insurance does not permit it to carry.
2. Restricted Items and Extra Rules
The following may be booked only if every condition is met:
2.1 Hazardous materials (dangerous goods). Includes flammable liquids and gases, corrosives, oxidisers, compressed gases, lithium batteries (including devices containing them, where regulated), dry ice, magnetized materials and other items regulated by the U.S. Hazardous Materials Regulations (49 C.F.R. Parts 171 to 180), the IATA Dangerous Goods Regulations, the IMDG Code or equivalent rules. Conditions: the Job is posted in the Hazmat mode (or another mode only if the regulated quantity exception applies and is declared); the Customer, as offeror, classifies, packages, marks, labels and documents the materials and provides emergency response information; the Provider holds every registration, permit, endorsement and training required; and the Elite Protection Plan applies. Never describe hazardous materials as something else.
2.2 Live animals. Includes pets, livestock, horses and other animals. Conditions: the Job states that it involves live animals and describes them (species, number, size, health and care needs); the Provider expressly agrees to carry live animals and is licensed or registered where required (for example under the U.S. Animal Welfare Act or by the U.S. Department of Agriculture); the animals travel with any health certificates, vaccination records and import or export permits that are required; the transport meets applicable welfare standards (such as the IATA Live Animals Regulations for air); and nobody leaves an animal unattended in unsafe conditions. Service animals traveling with a passenger are not cargo; Providers must accommodate them as the law requires.
2.3 Alcohol and tobacco. Only where shipment and delivery are lawful between the origin and destination, the shipper and Provider hold any required licenses, and the recipient is of legal age and verified at delivery where required.
2.4 Perishables and temperature-sensitive goods. Only where the Job declares the temperature requirements and the Provider has suitable equipment.
2.5 High-value, fragile and oversized goods. These must be declared with an accurate value and dimensions. Oversized and overweight loads require the Oversized Cargo or Heavy Haul mode and any required permits and escorts, and the Elite Protection Plan applies.
2.6 Medical transport. Patients must be transported by Providers licensed for the level of care needed. The Services are not a substitute for emergency medical services; for emergencies, call 911 or your local emergency number.
3. Prohibited Conduct
3.1 Fraud and misrepresentation. You must not: create an Account with a false identity or someone else's details; submit forged or altered documents or false regulatory numbers; misdescribe goods, weight, value, passengers or hazards; post fake Jobs or Bids, or bid on your own Jobs; claim delivery that did not happen, or misuse a delivery PIN; spoof location data; or file false disputes, claims or chargebacks.
3.2 Circumventing the marketplace. You must not arrange or accept payment outside the Services for a Job found through them, pressure another User to cancel and deal directly, share contact details to avoid Fees, or manipulate budgets or Bids to move a deal off-platform.
3.3 Reviews and scores. You must not post reviews for Bookings you were not a party to, buy, sell or trade reviews, use multiple Accounts to influence ratings, or threaten a review to obtain a refund or concession.
3.4 Harassment, discrimination and safety. You must not threaten, harass, stalk, dox, sexually harass or abuse any person; discriminate against anyone on the basis of race, color, ethnicity, national origin, religion, sex, sexual orientation, gender identity, age, disability, or any other characteristic protected by law; refuse service animals; carry weapons unlawfully; or operate any vehicle, vessel or aircraft while impaired.
3.5 Security and technical abuse. You must not access another User's Account or data; probe, scan or test the vulnerability of the Services without written permission; introduce malware; overload the Services or interfere with others' use; scrape or harvest data, except through the published APIs within their limits; reverse engineer the Services except as the law permits; share or sell API or Agent Keys; or use AI Agents to do anything this policy prohibits.
3.6 Spam and misuse of messaging. You must not use chat, reviews or notifications to send spam, advertising, phishing, or content that is unlawful, obscene, hateful or infringing.
3.7 Unlawful activity. You must not use the Services for money laundering, terrorist financing, sanctions evasion, smuggling, tax evasion or any other unlawful purpose.
4. Enforcement
CouthActs may, at its discretion and in proportion to the violation: remove Content or Jobs; cancel Bookings and refund Customers; issue a warning; restrict features or bidding; hold funds as permitted by the Escrow and Payments Terms; suspend or terminate Accounts, including related Accounts; and report conduct to law enforcement or regulators such as the U.S. Department of Transportation, FMCSA, PHMSA, FAA or U.S. Coast Guard. Violations involving safety, illegality or fraud may lead to immediate termination without warning.
5. Reporting
Report a violation or concern by emailing safety@couthacts.com (for safety issues) or support@couthacts.com (for everything else), with the Booking's tracking code or the User's profile link if you have it. You may report anonymously. If anyone is in immediate danger, call 911 or your local emergency number first.
